These Terms govern your use of Wintech Electric Co., Ltd.'s ("Wintech", "we") website, 24/7 online monitoring platform, products, and technical services. Please read them in full before you use the service.

Acceptance of Terms

Acceptance of Terms

These Terms of Service (the "Terms") form a contract between you and Wintech Electric Co., Ltd. ("Wintech", "we") regarding our website, online monitoring platform, product sales, technical services, and any derivative offerings (collectively, the "Service").

You are deemed to have read, understood, and agreed to these Terms and the Privacy Policy when any of the following occurs:

  • You browse, register, or sign in to any of our websites or the online monitoring platform.
  • You submit a quote request, contact, registration, or partnership inquiry through a form on the site.
  • You sign a Wintech quotation, purchase order, or technical-service engagement letter.
  • You make actual use of any hardware, software licence, or maintenance service we provide.

If you disagree with any part of these Terms, please stop using the Service immediately. If you accept these Terms on behalf of a legal entity or organisation, you warrant that you are duly authorised to bind that entity, and you do bind it to these Terms.

Definitions

Unless the context requires otherwise, the following terms have the meanings below:

    Any natural person who browses, registers, or uses the Service, or the legal entity, agency, school, partnership, or organisation they represent.

    Products|產品
    Our partial-discharge measurement hardware — including the PD Detector, TEV / HFCT Sensor, UHF Sensor — together with their firmware, accessories, and consumables.
  4. DEF · 04
    Technical Services|技術服務
    Field surveys, on-site measurement, signal analysis, training, 24/7 online monitoring, remote data management, and maintenance / calibration provided by Wintech.
  5. DEF · 05
    Platform|平台
    Wintech's 24/7 online monitoring platform, customer dashboards, and the related mobile / desktop client applications.
  6. DEF · 06
    Content|內容
    The text, images, audio-visual material, measurement data, reports, and software code carried by our website, platform, or documents, and any combination thereof.

Services Provided

Services Provided

The services we offer under these Terms fall into the four categories below. The detailed rules that actually apply are set out in the individual contract, quotation, or engagement letter:

S01 Hardware sales Manufacture, sale, and delivery of PD Detector, TEV, HFCT, UHF sensors, and related measurement equipment.
S02 Technical services Field surveys, measurement, signal analysis, written report issuance and walkthrough, training.
S03 Online monitoring 24/7 monitoring, alert push, remote data management, platform account provisioning, and operations.
S04 After-sales support Warranty handling, periodic calibration, sensor replacement, firmware update, on-site repair.

We reserve the right to add, change, or discontinue any feature or service at any time. Material changes will be communicated by email or website notice; if a change materially reduces a service for which you have already paid, we will issue a pro-rata refund or provide an equivalent substitute.

Accounts & User Obligations

Accounts & User Obligations

A registered, valid user account is required to access our online monitoring platform or customer dashboards. You agree and warrant that you will:

  • Provide registration information (name, title, organisation, contact details) that is true, accurate, and current, and update the platform or notify us promptly when anything changes.
  • Safeguard your username, password, two-factor device, and API keys, and not transfer, lend, or sell them to any third party.
  • Take full responsibility for every activity performed under your account, including but not limited to data changes, alert settings, and report downloads.
  • Notify us immediately upon discovering unauthorised use, credential leakage, or any other security concern, and cooperate with the remedial steps we take.

In practice: platform accounts are typically provisioned per organisation, and the administrator you appoint then assigns sub-accounts to internal members. The organisation administrator is responsible for vetting members and reclaiming access when they leave.

We reserve the right to suspend or terminate your account if you breach these Terms, if we reasonably suspect prohibited conduct (see Chapter 05), if required by judicial or regulatory order, or if necessary to prevent harm to other users.

Prohibited Conduct

Prohibited Conduct

When using the Service, you shall not engage in any of the following:

    Violation of law or public order
    Breach of ROC law, third-party rights, or any binding international convention.

    Reverse engineering
    Disassembling, decompiling, dismantling, copying, or building derivative products from our hardware, firmware, or platform software.
  3. PR · 03
    Unauthorised access
    Bypassing, removing, or defeating our authentication, encryption, access controls, or other security mechanisms by any means.
  4. PR · 04
    Mass extraction or scraping
    Unauthorised bulk extraction of our website or platform via automated tools, scrapers, or bots, to an extent that affects system stability.
  5. PR · 05
    Resale or commercial redistribution
    Renting, reselling, publishing, or redistributing our content, reports, measurement data, or software without our prior written consent.
  6. PR · 06
    Impersonation or fraud
    Impersonating Wintech, our trademarks, or our staff, or using the Service for fraud, phishing, money-laundering, extortion, or other unlawful ends.
  7. PR · 07
    Malicious code
    Uploading, planting, or transmitting any virus, trojan, ransomware, logic bomb, or other destructive program.
  8. PR · 08
    Harassment of others
    Using the Service to harass, defame, discriminate against, bully, or otherwise impair other users, our staff, or third parties.

In the event of any such breach, we may remove the offending content, suspend or terminate the account, and reserve the right to pursue any further legal remedy available.

Quotes, Orders & Payment

Quotes, Orders & Payment

Quote validity: unless the quotation states otherwise, each quotation we issue is valid for 30 days from the date of issue. We may re-quote at prevailing market rates if it is not confirmed within that window.

Order formation: upon receipt of a purchase order or counter-signed quotation from your authorised representative, we will confirm within five (5) business days, at which point the order is formed.

Payment terms:

  • New customers: full prepayment before shipment, or under the credit terms granted by us.
  • Recurring customers: payment terms follow the individual contract / quotation, commonly net 30 or 40 / 40 / 20 (on signing / shipment / acceptance).
  • The default settlement currency is New Taiwan Dollars (TWD); cross-border transactions may settle in USD at our published exchange rate.
  • Late payments accrue interest at 5% per annum, and we may suspend further service delivery until cleared.

Taxes and invoicing: prices are quoted exclusive of tax; 5% Taiwan VAT applies. We issue electronic invoices to the email address you designate after shipment.

Refunds: apart from warranty defects under Chapter 07, accepted hardware and performed technical services are non-refundable. Any dispute must be raised in writing within 14 days of acceptance.

Warranty & Support

Warranty & Support

We provide the standard warranty below on the hardware we ship. Customised or non-standard products follow their individual contracts:

Sensor Lifetime 5 years (replacement advised) Recommended service life for TEV / HFCT / UHF sensors; calibrate or replace beyond this point.
Response SLA 8 business hours First response after a customer report (GMT+8 business days).
Onsite SLA 3 business days When site presence is required, an engineer will be scheduled within 3 business days of confirmation.
Calibration Annual Annual factory calibration is recommended to maintain measurement accuracy; calibration is quoted separately.
Firmware Update Included in warranty Security and performance firmware updates are free during the warranty period.

Out of warranty: the following are not covered by the free warranty:

  • Damage caused by use outside the operating manual or our training instructions.
  • Damage caused by faulty customer-side power, lightning, water ingress, or out-of-spec environmental conditions (temperature, humidity, vibration).
  • Faults arising from disassembly, modification, addition, or repair performed by anyone other than Wintech.
  • Cosmetic wear and natural-life replacement of consumables (batteries, cables, connectors).

After the warranty expires, Extended Warranty and Annual Maintenance Contracts (AMC) are available — please contact your account manager for details.

Intellectual Property

Intellectual Property

All intellectual property in the website, platform, software, firmware, documentation, trademarks, design assets, training materials, and any derivative works belongs to Wintech or its licensors, and is protected by copyright, trademark, patent, trade-secret law, and international conventions.

Scope of licence: under these Terms we grant you a non-exclusive, non-transferable, non-sublicensable limited licence, solely to operate our products and services in your lawful business activities. No intellectual-property right is granted beyond what is expressly stated here.

Ownership of measurement data: raw measurement data ("Raw Data") generated on-site by your equipment belongs to you. To the extent necessary to provide the platform service, perform analysis, or improve our products, we may use such data in a de-identified, aggregated form, but we will not disclose it externally in a way that identifies any specific customer.

Trademarks: "Wintech", "成浩科電", and the related identifiers are our registered trademarks. You may not use them on goods, marketing, websites, presentations, or other publications without our prior written consent.

Third-party licences: our firmware or platform may include third-party open-source components, used under their original licences (e.g. MIT, Apache-2.0, GPL). A complete list is available on request from our technical contact.

Liability & Disclaimer

Liability & Disclaimer

Nature of the service: our products and technical services are designed to help you monitor partial-discharge activity on high-voltage power equipment. They are not a replacement for your existing inspection regime, protective relays, or personnel-safety procedures. Final operating decisions remain with your own qualified power-engineering personnel.

Disclaimer: to the fullest extent permitted by law, we are not liable for damages arising from any of the following:

  • Losses caused by your use outside the manual, or your failure to perform maintenance / calibration in line with our recommendations.
  • Temporary inaccessibility of the online monitoring platform caused by interruption or failure of third-party network, power, or cloud providers.
  • Outages, trips, or financial losses caused by faults, human error, or workmanship defects in your upstream / downstream equipment.
  • Indirect, consequential, lost-profit, lost-goodwill, or data-loss damages that we could not foresee or control.

Cap on liability: in any case, our aggregate liability for a single event under these Terms is capped at the amount you actually paid us for the relevant service in the 12 months before that event. This cap does not apply to our wilful misconduct or gross negligence, or to liabilities a statute prohibits us from limiting.

The Service is provided on an "AS-IS" basis. Save as required by law or expressly stated in these Terms, we make no express or implied warranty of uninterrupted operation, error-free behaviour, or fitness for a particular purpose.

Force Majeure

Force Majeure

If any of the following events, directly or indirectly, prevents us from performing all or part of these Terms or an individual contract, we will not be liable for the delay or non-performance during the period the event continues to affect us:

  • Acts of God (earthquake, typhoon, tsunami, flood, fire, lightning, etc.).
  • War, armed conflict, terrorist attack, riot, strike, or labour unrest.
  • Pandemic and government-mandated outbreak-control measures.
  • Government laws, administrative orders, import / export controls, embargoes, or currency controls.
  • Large-scale cyberattacks, systemic outages of cloud providers, undersea-cable failures.
  • Global shortages of critical semiconductors, components, or logistics.

We will notify you within a reasonable time after becoming aware of any such event, and take all reasonable measures to resume performance as soon as the event ends. If the force-majeure event lasts more than 60 days, either party may, by agreement, terminate the affected contract and settle the performed portion on a pro-rata basis.

Termination & Amendments

Termination & Amendments

Termination by the user: you may stop using the Service and request account closure at any time. Unperformed obligations under an individual contract (outstanding payment, confidentiality, intellectual-property terms) survive account closure.

Termination by Wintech: we may suspend or terminate all or part of the Service, without liability, on any of the following grounds:

  • You breach these Terms and fail to cure within 7 days of our notice.
  • You are in arrears for more than 60 days.
  • You enter bankruptcy, dissolution, or liquidation, or are subject to creditor enforcement.
  • Your conduct poses an immediate material threat to the assets, reputation, or safety of Wintech or its other customers.

Post-termination handling: after the Service ends, we will retain or delete your personal data and measurement data according to the retention schedule in Chapter 04 of the Privacy Policy. Accounting records and reports we must retain by law remain retained until that statutory period expires under the Business Accounting Act.

Amendments: we may revise these Terms when laws change, our operations evolve, or practice requires. Revisions are communicated as follows:

  • The "Last Updated" date and revision number at the top of this page are refreshed.
  • Material changes (e.g. introducing new paid mechanisms, adjusting the liability cap) will be notified by email to customers on file and posted on our website at least 30 days before they take effect.
  • Continuing to use the Service after a revision takes effect indicates acceptance; if you disagree, please stop using the Service as described above.

Governing Law & Contact

Governing Law & Contact

Governing law: these Terms and any dispute arising from them are governed by the laws of the Republic of China (Taiwan).

Jurisdiction: for any litigation arising from these Terms, the parties agree to the Taiwan New Taipei District Court as the court of first instance — without prejudice to Article 47 of the Consumer Protection Act or any other mandatory exclusive jurisdiction.

Severability: if any provision of these Terms is held invalid or unenforceable by a competent authority, only that provision is severed; the rest remain in full force.

Entire agreement: these Terms, together with the relevant quotations, purchase orders, and engagement letters, constitute the parties' complete agreement. In case of conflict, the individual contract prevails; matters not covered by the individual contract are governed by these Terms.
